Yes, and this is called a neutral appraisal. Both spouses (or their attorneys) jointly retain the appraiser under a written engagement letter that names both parties as intended users. The appraiser then produces a single USPAP-compliant fair market value that both sides agreed in advance to use for their equitable-distribution math. This is faster and cheaper than each side hiring an appraiser and having a valuation dispute. It only works if both parties are genuinely willing to accept the neutral appraiser's number.
This happens in divorce cases. The standard workaround is a Utah Rule 45 subpoena (via the family-law attorney) compelling access, or a court-ordered inspection under URCP 34.5. If neither is available, the appraiser can produce an exterior-only 2055-form appraisal with extraordinary assumptions about interior condition — but the report is meaningfully less defensible and shouldn't be used for high-stakes valuation math. Talk to the attorney about the access-order path before falling back to exterior-only.
For temporary orders (early in the case), the effective date is usually current — value the property as it stands today. For the final decree (property distribution), the effective date is a legal question, typically date-of-separation or date-of-trial. Same property may need two appraisals with different effective dates.
